Founding a Company

Austrian corporate law offers different types of companies, tailored to your needs with respect to tax and liability. The different types include:

  • Limited liability company (GmbH)
  • joint-stock corporation (AG)
  • general partnership (OG)
  • limited partnership (KG)
  • Flexible Company (FlexCo)
  • Among these the limited liability company (GmbH) has proven to be the most popular form. In addition, in 2024, a new corporate form, the Flexible Company (Flexible Kapitalgesellschaft, Flexible Company or FlexCo), was created.

    Even in the case of a branch (zweigniederlassung) of a foreign company, registration in the Austrian company register (Firmenbuch) is required. Foreigner are subject to next-to-none limitations when it comes to establishing or acquiring Austrian companies. Neither an Austrian minority shareholder nor a trustee are required.
