Residing in Austria

Non - EU-citizens are allowed to stay in Austria

  • with a residence permit (Aufenthaltstitel) - usually for a stay of more than six months
  • with a visa (Visum) - usually fpr a stay of less than six months
  • “visa-free” - usually for 90 or 180 days, available only to citizens of certain countries
  • When an application for an extention of a residence permit has been applied for within a certin period of time, it is possible to stay in Austria until a decision has been made. However this applies only in case of residence permits - nit in case of visas and "visa-free" stays. It also applies only in case of applications for an extention - not in case of initial applications.

    Residing in Austria

    As a general rule of Austrian law, foreigners must apply for

  • a residence permit (Aufenthaltstitel) for a stay of more than six months;
  • a visa (Visum), e.g. a Visa D, for a stay less than six months (exceptions apply to citizens of certain countries – they enjoy so - called “visa-free stays”).
  • Sometimes the legal right to stay in Austria (e.g. because of a visa-free stay or by way of a visa) expires during the application process of an initial application. In such cases, alternatives must be taken, e.g. leaving the Schengen area!
